Sasquatch's attempted murder conviction overturned, yet he will still face new trial

The Oregon Court of Appeals on Wednesday overturned the conviction of a man who attacked a hunter while naked in rural Washington County and told authorities he was "a Sasquatch ... from a family of Sasquatches."

Linus Norgren, who has bipolar disorder, was having a mental break in October 2013 and so couldn't have understood his Miranda rights despite telling a Washington County deputy he did, according to the court ruling. Norgren also made incriminating statements to the deputy in addition to identifying himself as "a Sasquatch," according to the court ruling.

But the appeals court said a Washington County Circuit judge was wrong to rule against a defense's motion to suppress Norgren's statements.

The appeals court calls for the case to return to Washington County Circuit Court. Norgren, now 24, was sentenced March 2015 to 10 years in prison for attempted murder and second-degree assault for attacking Jeff McDonald, now 62, in the woods on the edge of a logging road in Manning.

McDonald testified during Norgren's trial that he was hunting for deer in the woods and approached Norgren after seeing him naked and holding McDonald's pruning saw. Norgren wrestled McDonald's rifle away from him, then dropped the gun.

According to prosecutors, Norgren then knocked McDonald unconscious with a rock, dislocated both of McDonald's shoulders and choked him. McDonald regained consciousness while being choked, but Norgren shoved his fingers down McDonald's throat and gouged his eyes, prosecutors said. Norgren passed out while on top of McDonald.

Norgren told McDonald, "Sasquatch kills the hunter," during the attack, prosecutors said. McDonald managed to call 911 and his wife; authorities searched for about 90 minutes until finding them.

Washington County Sheriff's Deputy James Wheaton found Norgren unconscious, bleeding and lying naked in the fetal position in the woods, the appeals court ruling said. He stood Norgren up, handcuffed him and read him his Miranda rights.

The condition Norgren was found in as well as the Sasquatch statement were "particularly significant to our conclusion that [Norgren's] waiver of his Miranda rights was not knowing and intelligent," the ruling said. The ruling also cites evidence that Norgren was interviewed by members of a mental health response team and another deputy who concluded that some of his statements showed he was "having a break from reality."
