Just to confirm, the tweet linked in the OP is the only source for the DMCA, right? I see nothing about a DMCA on the Metroid Database website.
Just checked out their site, and there still a news post with download links and a link to the official site.
Just because it's still up doesn't mean it won't be hit with DMCA soon.

Just found out about it, but any possibility it might be linked to the fake/former employee sending copyright takedowns everywhere?
I know everyone is all "Boo Nintendo!" over this, but why wait until it was already out for a day? They knew it was being released for how long? Does anyone else feel like this is something that they have to do for Copyright protection reasons? Why else would they wait until it had already been spread around before having it shut down?
Let's wait till that happens before getting upset? I mean the game is also already out in the wild so it's not like this even matters anyway. Though it could impede patches or updates if any of those were planned?
If this really was Nintendo taking action all the links would be down.

It's hilarious to me that we don't get 2D sidescrolling Metroid games anymore. I can understand the conservative approach to the Prime series given how the sales we're trending but a NX/handheld sequel to Super Metroid or Fusion is the biggest no-brainer ever.
Sakamoto just hasn't been interested at all. He's pretty content with the smaller projects that his team does these days.

To be fair I think Bombergames was also asking for donations. My memory is fuzzy on that one though, since it's been a looooong time."why would they take action until only after the game was completed when there's been a demo for years?".
