DSFix 2.3 taken down after DMCA complaint [Up: Was mistake; being resolved]

What? When has Namco ever had goodwill in the last bunch of years? Just because they're bringing more stuff to localize? They're a greedy corporate money-grubbing entity that bleeds out their fanbase for every cent they can get. Which, unfortunately, they can do because they're one of the only Japanese publishers still releasing games people want.

I missed you.

Anyone you can tweet at FROM about this? It's concerning that dropbox assumes by default that its users are criminals, without any burden of proof whatsoever on the party claiming infringement. Really, this whole situation just doesn't make sense; I'm hoping it's some weird misunderstanding.

dmca requires the host to respond within 72hrs or be liable them selves.

There really should be deeper repercutions to filing false DMCA notices.

From what I know Durante, Dropbox is legally obligated to comply with the request no matter how frivolous it may seem to them. You need to file a DMCA Counter-Notification, and once done Dropbox should allow the link to be live.

When writing your counter-notification you need to state that you will accept lawsuit from the parties sending the take down notice. Doing so will absolve your ISP of all blame and prevent their taking further action against your website. You must further specify your reason for sending a counter notification. This could be because the material is not copyrighted, the complainant does not hold the copyright, the copyright has expired, or because your use of the material in question is legally protected in some other way. Separately, even if the material is in violation, if the complaining party has not followed proper protocol in sending their take down notice you are perfectly within your rights to send a counter notification, providing you specify this clearly as the reason for such a reply. If no legal action is taken within ten days any modifications, or removals, made by your web host should be restored. In any event, it is unlikely that the complainant will take it any further seeing as they would have to take legal steps in a court in your jurisdiction – likely to be a costly process for them and not usually worth it, taking into consideration the relevant travel and legal expenses (unless you’re dealing with some major company). Be warned, however, that if they do decide to pursue it, and win, you may be liable for their legal expenses as well.

Durante this may have been a false claim.

I uploaded the debug version on Nexus Mods and got a PM from someone as well.

Their grammar leads me to believe that they may just be a user trying to rile things up in the DS community.

Though if it is truly them, their claim on the Debug build holds a lot more validity than their claim on DSFix.[/QUOTE]

This isn't a fake user complaint, but it's definitely not correctly applying the DMCA or EU Software Directive.

Unless this is some sort of a fuck up they should feel fucking embarrassed for this.
They release a broken port and when someone does them a favor and fixes it (thus boosting their sales) they try to prevent it.
Stupidity at a whole new level.

So what are the odds they took a look as a guide on how to fix the game for their updated re release?

This is garbage. Seriously Namco, what...the...fuck?

Either fix your own games and get your shit together, or support the goddamn community that is holding you up. I really hope someone preserves this and continues to somehow host it.

Durante, thanks a ton for all the work you have put into this and other games. It must be frustrating to use your own free time to make this world better, only to have the very company you are helping, turn around and try to kick you in the nuts.

I usually understand where the company is coming from, but this doesn't make any sense to me. Why would they harm one of the sole reasons people even bothered to buy their shit in the first place?

Definitely submit the counterclaim ASAP, since it sounds like you can do that online.

Ignorance or a mistake by some department/automation seems likely. The only thing I can think of would be if the DMCA covers reverse-engineering, but I thought that only really applied in North America in that regard?

There needs to be some kind of law made that if a company is found to have used copyright claims to silence dissenting voices or users improving their product with no monetary gain or financial harm to the company, they have to pay a fine of 10k or more to the person they filed the copyright claim against.

Right now its like, why not? Someone makes a YouTube video about glitches in our game or about how our game is fucked. Just file a copyright claim. Why not? Nothing to lose!

You can sue for damages if you're the victim of someone else filing a false copyright claim. You just won't get much unless you've actually suffered economic harm.

It's costing them sales. You know... in the other direction.

That's the same thing, right? I'm sure someone at Bamco would agree.

I looked into it and it is a person, but I'm not sure that that is actually the person writing the message. I think it's someone who's trying to stir up issues.

They wouldn't PM me to remove it, they would have Nexus Mods remove it if they were an actual representative of Bandai.

IIRC, knowingly filing false claims is a cause of action for a lawsuit.

Seems like that's a real address and possibly a real company, but the typos and grammar are setting off some alarms.

Unless we hear this echoed by other branches of BN, I'm not going to get upset yet. This could have been a mistake on the part of the German branch, maybe someone at legal that has no idea what he or she is trying to shut down.

Almost certainly some idiot in legal catching unrelated stuff in the crossfire of trying to take down uploads of the debug build.

they need to sell their next shitty version to pc players

I sold back their last shitty version (PS3 DS2), to GameStop.

Technically, the PC version is bad enough to be called shitty too, but it DID have better load times...

Anyone here think that this bodes ill for Bloodeborne?

Interesting. Wouldn't surprise me if true.

I didn't know about such a leak.

This could just be the work of some moron in the European legal dept. who doesn't understand. Looking to earn brownie points.

Why would they do this!? It's like they don't even know what DSfix does to make such a dumb move. They're like "This MOD. this BAD."

Bandai/Namco has nothing to do with Bloodborne. That's From Software and Sony.

Dont reall understand why would Bamco even do that?? With all recent unexpected Bamco+Steam announcements and goodwill earned by that - its like they are shooting themselves into own balls - but who knows maybe just german legals messed that up

I'm always shocked at who is at the top of a lot of companies. This could be from people who think their coding is beyond amazing, so I wouldn't take it personally. I know a few people who couldn't even get it running on their PC without the fix. This feels like a load of BS. It's not you were unlocking stolen copies and selling them through dropbox.

I grew up with Namco games and Aladdin's Castle, so who knows if it's legit. Some person could be extremely upset by the fix (they die too many times in Dark souls) or they have no clue how it even works.

i hope no one here buys anything from namco unless they undo this shit, if DSfix allowed you to experience a decent port of DkS. This is unacceptable behavior and you shouldn't support a company that does this.

The grammar/ sentence structure is very german. Like if someone translated everything word for word...

It's either a good imposter, or the guy is ,infact , german

I feel like this might be a misguided sweeping attempt to remove the debug build from the wild. Or I'm about to hate-preorder Dark Souls: Definive Steam Edition.

Yeah, it's weird that Bandai Namco Germany would hire a "File Defense" company whose founder isn't proficient in English. The guy does exist though, as seen in this video, which also suggests that the company is real.

They probably just mistook DSFix for something that it actually is not, which is unfortunate. Let's hope that this gets cleared up.
