to be fair, the same will happen with a non DRM disc. going by the suggested program, you should be able to to know which account activated your disc and catch the thief.

Microsoft has until E3 to release their official policy. Otherwise, people will watch the E3 conference for official information regarding the policy rather than for seeing Xbone capabilities and games.
Yes, but most specify the exact uses of that license. For example, Rockstar's EULA states:

Haha, that's pretty much exactly how I read it. I really hope MS back tracks on this, preferably making some loose commitment to *not* implement this shit in the future of the console, too. I'd love to want the Xbox One, but this crap makes it a lot harder.

It basically said that they just need to be upfront and I followed that up by saying they used to be better than this and that every website I go on they are getting destroyed... I also suggested they use social media monitoring (well, asked why the hell they weren't) as that basically lets you see the number of conversations about your brand in general whether they are positive or negative in tone.
Anyone in marketing can access that.
I also mentioned that every website I go on they are getting destroyed in the comments and that they should simply trust their audience enough to be upfront and state what is going on... if the reports are wrong then explain why, even if it means you have the say parts are still being worked out.
Anyway. Fuck them.
You could also ask that about the reveal on the 21st in general.

If you're talking about that code is copyrighted, that's entirely different from not being allowed to sell what you purchased, which is a copy of the game.
And as for PC games and Steam and such, yes, I very much hope that Steam eventually bends on this and adds some way to sell games you've purchased. It's a quite plausible hope, too. Full rights? Yeah, probably not, and that's really too bad, and is a reason why I virtually never buy digital-download games for anything other than deep sales... but more, so that we have at least the key right of resale? I think it will happen for PC DD games eventually. Consoles, however, are heading straight in the other direction, and if MS succeeds in this it'll be a major step towards institutionalizing that.

lol exactly! I mean pre-reveal when there were rumors flying around and when people were complaining about those rumors, them keeping silent actually helped calm things down a bit. Now it's every damn day...live chat with copy-paste answers + interview answers + PR releases refuting those interview answers etc etc. It's a train wreck. These people had months and months to prepare for this too

I wasn't expecting to be shown games until E3 honestly. The way they revealed XBO on tuesday free's up E3 to be 90% about the games.
Sony is being very very quiet, I'd be more concerned about that then the company thats actually trying to be forthcoming about their next gen plans.

I don't think it's a matter of MS being dishonest, they just literally don't know how the fuck it all works either (except that it won't work the same as it does now). From their perspective, they should've used this type of response from the beginning, as opposed to the conflicting reports. After all, it's not like the system is out yet, so they still have wiggle room anyway.
