If it's the Just Cause 3 post by the seller, he called it "brand new" and posted a stock photo. Definitely warrants bad feedback, imo.

Soon as there's a tear in the shrink wrap, it's used.

I think it definitely warrants negative feedback.
Unless the seller is willing to refund for the item once returned, otherwise, ya, I would be extremely pissed at getting something in a condition other than what a normal reasonable person would expect NEW to mean.
