Nintendo might of been able to track the serial number of the missing units, deactivated them, and the thing could have been bricked.

And that rollout is off the rails now.I think it's a much bigger loss the fact that the UI details and whatnot got revealed by someone, when, for better or worse, Nintendo surely wanted to control that message.

It's not like who he bought it from would tell him it was stolen. It could've just been something like "Hey we accidently got shipped some consoles early. Do you want to buy one?". I do not believe for one second that a retailer shipped the console, which would mean that whoever sold it him obviously did so under the table and thus he was at the very least partially aware.
It's not like who he bought it from would tell him it was stolen. It could've just been something like "Hey we accidently got shipped some consoles early. Do you want to buy one?". Not that hard to believe.
We'll probably never know where he bought it from so it'll always be nothing but speculation. Nintendo seems satisfied things are taken care of so it should be good enough for us.
