Most console games that are locked to a consistent 60 FPS always tend to run above 60 FPS. It gets locked to prevent tearing and overheating tho. For example, Bioshock runs above 30 without Vsync. They have to account for situations where the screen might get too busy, like a fighting game with lots of effects going on the screen at the same time.So frame rises over 60fps are bad now?

I don't think using Call of Duty as the foundation for hardware crunching assets is going to bode well in your proposed taunt.
Triple Buffering, Vsync, G-sync, 120hz native monitors. Yeah we have lots of things to allow us to lovingly embrace games like this.
