I think it's different. Imo, it's more ok to go and see what mods are popular in the previous game, as it's a good indicator of what people want and it works in the context of the game, to take as basis for the new game.
This, it's totally legal as people have indicated, and the author himself doesn't have a lot of problems, but it's creatively bankrupt.
