It's not necessarily evidence for X-Men being in MvC4, but a bunch of X-Men characters showed up in Contest of Champions recently (Gambit, Nightcrawler, Beast, Phoenix, maybe some others). X-Men are also getting action figures again and a relaunch in the comics targeting 90s X-Men fans. All of this at least couldn't hurt their chances in MvC4.

That's sort of how MVC3 was announced. All we got was a teaser trailer with CGI in April. We didn't get any actual gameplay footage until E3 that year.

Since someone at Capcom said it wasn't happening recently, I wouldn't doubt if they have 0 to show and are just announcing they are going to work on it.

Contest of Champions was made before the whole embargo thing began (in fact, it was the last game that dodged the bullet). The action figure thing is a fair argument that goes with what I was referring to about Marvel Entertainment & Fox starting to put their differences aside.

Only for the movies. Marvel can use the X-Men for games if they want to, they just chose not to (though that may change next year).

Marvel Games is still under Perlmutter's control. Though there's a theory on CBR that Perlmutter was forced to make nice with Fox after he lost influence of Marvel Studios. If that's the case is uncertain, but things are looking up.

Also on a slightly unrelated note, Marvel Studios & Fox did a trade. Fox gave Marvel Studios Ego the Living Planet to use in Guardians of the Galaxy Vol. 2, & Marvel Studios gave Fox Negasonic Teenage Warhead to use in Deadpool in exchange.
